IMPORTANT NOTES

1. Legally Binding Agreement

This Loan Contract constitutes a legally enforceable agreement between the Lender and the Borrower under Nigerian law.

2. Service Fees

The Service Provider has the right to charge applicable processing, service, or technology fees necessary to facilitate the digital lending service. All fees are disclosed within the App before you submit your loan application.

3 .Documentation

You agree to complete all documents, statements, confirmations, or forms that SuperCash or APEXN PATH TECH LIMITED requests to enforce this Loan Contract.



TERMS AND CONDITIONS

1. Loan Usage

You agree to use the approved loan amount solely for lawful and personal financial purposes. Funds will be disbursed into the bank account or virtual account you provide.



2. Credit Authorization

You authorize the Lender to:

• Verify your identity via BVN validation

• Access, share and update your credit history with licensed Nigerian Credit Bureaus

• Conduct fraud and risk assessments

• This complies with the

Credit Reporting Act

and NDPA 2023.



3. Interest Payment

Interest accrues daily at the rate shown in the

Loan Disclosure Page

and is payable in full on or before the

Repayment Due Date

.



4. Repayment Obligation

• Upon maturity, you agree to repay:

• Loan principal

• Accrued interest

• Service/processing fees (if any)

• Applicable taxes or statutory charges

Payment shall be made strictly to the accounts shown inside the App.



5. Late Payment Penalty

• If repayment is not made on or before the due date:

• Late Payment Fee applies as disclosed in the Loan Terms

• Penalties continue until full settlement

• The penalty encourages timely repayment and responsible borrowing


6. Repayment Adjustments

The Lender may modify repayment channels or operational procedures due to regulatory, technical, or banking system requirements. You agree to comply with any updated repayment instructions.



7. Legal Remedies

• If you default, the Lender reserves the right to pursue all remedies available under Nigerian law, including:

• Legal action

• Reporting to credit bureaus

• Engagement of collection service providers

• Recovery of outstanding loans, penalties, and lawful costs



8. Public Disclosure

• To protect the Lender from financial loss due to fraud or intentional default, the Lender may share your name and default status with legally authorized entities such as:

• Licensed Nigerian Credit Bureaus

• Law enforcement agencies

• Regulatory bodies

• No unlawful “public shaming” is permitted.



9. Early Repayment

You may choose to repay the full loan earlier than the due date. Already-accrued interest and fees remain payable.


10. Absolute Liability Clause

• Your repayment responsibility is unconditional and irrevocable regardless of:

• Personal circumstances

• Device issues

• Changes to financial condition

Nothing negates this liability unless written approval is issued by the Lender.



11. Non-Refusal Clause

You waive any right to deny repayment under any pretext. Loan repayment is final, binding, and non-negotiable.



12. Fraudulent Information

• If any detail (identity, BVN, contacts, bank details, employment) is false or misleading:

• Your full loan immediately becomes due

• Lender may take legal and credit-related action

• Fraud may be reported to law enforcement agencies



13. Communication Consent

You consent to receive important notifications via:

• SMS

• Calls

• Email

• WhatsApp

• In-App notifications

These communications are necessary for loan servicing.



14. Tax & Statutory Charges

If the Lender must pay taxes or regulatory charges on your behalf, you agree to reimburse such amounts.


15. Loan Assignment

The Lender may assign, transfer, or sell your loan to another licensed financial entity. Your obligations continue unchanged.


16. Borrower Assignment Restriction

You may not transfer your rights or obligations without prior written approval from the Lender.



17. Modifications to Terms

The Lender may update these Terms in compliance with legal and operational requirements. Updates take effect upon publishing within the App.



18. Effective Date

This Agreement becomes effective immediately upon Borrower’s electronic acceptance.



19. Governing Law

This Agreement is governed by the

laws of the Federal Republic of Nigeria

. Disputes fall under the jurisdiction of competent Nigerian courts.
