User Agreement

Welcome to CashMe, operated by APEXN PATH TECH LIMITED! These Terms of Service (“Terms”) establish the legal obligations and guidelines governing the relationship between you (“User” or “Borrower”) and CashMe, regarding your use of our mobile application and loan services in Nigeria. By downloading, installing, accessing, or using the CashMe app, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease using the app.


1. Rights of the Parties

1.1 Borrower Rights

(1) Transparency in Credit Evaluation: You have the right to be informed about the progress and outcome of your credit assessment through the CashMe platform.
(2) Fee Authorization: You irrevocably authorize CashMe to deduct the agreed platform fees in a single transaction prior to the release of your loan by the lender.
(3) Repayment Terms: Upon the due date of your loan, you are required to repay the loan principal and accrued interest in full to the designated account in a single payment.

1.2 Platform Rights

(1) Platform Fees: CashMe reserves the right to charge you a one-time platform fee, which may include costs such as loan approval fees, collection service fees, and payment channel fees incurred during loan disbursement.
(2) Verification of Information: CashMe is entitled to verify the personal information you provide, including but not limited to your national identification number, bank account details, geographic location, and electronic contact list, to ensure accuracy and compliance.
(3) Loan Approval Authority: Based on the review of your personal information and credit history, CashMe has the discretion to decide, on behalf of the lender, whether to approve and disburse your loan.


2. Obligations of the Parties

2.1 Borrower Obligations

(1) Legal Capacity: You confirm that you are a natural person with full civil rights and legal capacity under Nigerian law, capable of independently exercising and fulfilling the rights and obligations outlined in these Terms.
(2) Accurate Information: You guarantee that all information provided during account registration and loan application—including your national identification number, mailing address, phone number, and emergency contact details—is accurate and valid. You must notify CashMe of any changes to this information within three (3) days of the change.
(3) Authorization for Verification: You agree to provide truthful personal information and authorize CashMe, or third-party channels designated by CashMe, to verify this information. You also permit CashMe to manage and use this information solely for the purposes of this agreement. If the information provided is found to be false, you will be solely responsible for all resulting consequences and legal liabilities.
(4) Lawful Use of Loan: You commit to using the loan exclusively for lawful purposes and agree not to engage in any activities that violate Nigerian laws, regulations, or public policies during the loan term.
(5) Personal Operation: You must personally complete all actions related to your loan application within the CashMe app.
(6) Timely Repayment: You are responsible for maintaining a good credit record and fulfilling your repayment obligations on time as stipulated in these Terms.
(7) Full Repayment: You guarantee to repay the full amount due, including principal and interest, to the designated account by 24:00 (midnight) on the final repayment date.

2.2 Platform Obligations

(1) Legal Entity: CashMe, operated by APEXN PATH TECH LIMITED, is a legally registered entity in Nigeria, authorized to independently exercise and fulfill the rights and obligations under these Terms, providing a secure lending platform for borrowers and lenders.
(2) Confidentiality and Compliance: CashMe is obligated to review your information and credit history and to keep your authorized verification information confidential. However, CashMe may disclose such information without your consent if required by relevant authorities (including but not limited to courts, arbitration bodies, or financial regulatory agencies) or mandated by Nigerian law.


3. Breach of Contract and Remedies

3.1 Borrower Default

The following constitute a breach of contract by the Borrower:
(1) Failure to Repay: You fail to meet the repayment obligations outlined in these Terms, including partial or incomplete repayment.
(2) Extension of Repayment: You request or cause a delay in the repayment schedule beyond the agreed due date.

3.2 Platform Default

If a system failure on the CashMe platform prevents you from making a timely repayment, you will not be liable for any additional fees or penalties resulting from the platform’s error.


4. Dispute Resolution and Governing Law

4.1 Applicable Law: The creation, execution, termination, and interpretation of these Terms shall be governed by the laws of the Federal Republic of Nigeria.
4.2 Resolution Process: Both you and CashMe agree to act in good faith and adhere to principles of honesty and trustworthiness in performing these Terms. Any disputes arising from these Terms shall first be resolved through amicable negotiation. If negotiation fails, either party may initiate legal proceedings in a competent court located in the jurisdiction where CashMe is domiciled.
4.3 Continued Performance: During any dispute or litigation, provisions of these Terms not subject to the dispute remain in effect, and neither party may refuse to fulfill their obligations under these Terms on the grounds of ongoing dispute resolution.


5. Miscellaneous

5.1 Updates to Terms: CashMe may update these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. You will be notified of any significant changes via the app or other communication channels. Continued use of the app after such updates constitutes your acceptance of the revised Terms.
